Executive Order 14110 ("Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence"), signed by President Biden on October 30, 2023, is the most structuring regulatory text for AI in the United States.
What the text says
The EO is organized around eight axes. Three have direct operational implications:
1. Mandatory reporting for high-capability models
Developers of "dual-use foundation models" must notify the federal government and share red-team test results. The threshold is set at 10^26 floating-point operations for training (Section 4.2).
2. NIST security standards
The EO mandates NIST to develop standards for AI safety. The NIST AI RMF 1.0 (January 2023) has become the de facto reference framework, defining four functions: Govern, Map, Measure, Manage.
3. Federal procurement
The EO requires federal agencies to integrate AI criteria into procurement. Any company selling to the federal government must demonstrate AI compliance with NIST standards. Federal procurement standards have historically defined industry practices at large.
Implications outside the US
The EO has de facto extraterritorial reach through three mechanisms: supply chains, regulatory convergence (NIST AI RMF and EU AI Act converge on risk management, traceability, human oversight), and de facto standards (like SOC 2 and ISO 27001 before it).
Preparing the organization
Five concrete actions: inventory all AI systems, classify per NIST AI RMF risk profiles, implement audit trails, formalize governance roles, and build the compliance documentation corpus.
